Patient Medication Terms and Conditions

The following are the terms and conditions set forth by Canada Prescription Service, and must be agreed to by the customer upon placing any order.

1. Any prescriptions provided by me to Canada Prescription Service (as defined in paragraph 2 below) were lawfully obtained from my local doctor who is authorized to issue prescriptions under the law where he or she practices. Those prescriptions have not been altered in any way or been previously filled. The medicine provided to me will be used only as directed by that doctor and only by the person for whom the medicine was prescribed, and I will continue to have my medical condition and my use of medications, including medicine provided by Canada Prescription Service and any ill effects from that medicine, monitored by my local doctor, whom I will consult for ongoing medical advice.

2. I am not seeking and have not received medical advice or treatment of any kind from Canada Prescription Service or any of its employees, officers, directors, agents, affiliates, subsidiaries or any others acting through or for it including any pharmacists, physicians, nurses and other health care professionals (all of whom are collectively referred to throughout this agreement as "Canada Prescription Service"). I did not and will not rely on Canada Prescription Service regarding the nature of any medicine or its fitness, suitability or effectiveness for treating my medical condition.

3. I authorize Canada Prescription Service to act as my representative to facilitate the purchase of medicine from a pharmacist and to ship that medicine to me by mail, courier or other means. I authorize and appoint Canada Prescription Service as my agent and attorney for the limited purposes of taking all steps and signing all documents on my behalf that may be necessary to deliver my prescription in a form required by applicable law to a pharmacist and to ship medicine to me.

4. All hospitals, physicians, medical care providers, pharmacists and other persons are authorized to provide to Canada Prescription Service all information and documentation in their possession regarding my medical history, consultations, prescriptions, medications and treatments (collectively, "Medical Information"). Canada Prescription Service and the physicians, nurses, pharmacists and technicians who may be involved in issuing or filling prescriptions for medicines for my use are authorized to collect and use the Medical Information for that purpose. This consent may be revoked at any time in writing. I understand that if this consent to collect, use and disclose Medical Information is revoked it will probably not be possible for me to obtain medicine from or through Canada Prescription Service. A copy of this consent sent by fax or otherwise shall be as effective and valid as the original.

5. I acknowledge that Canada Prescription Service has relied on the information and documentation provided by me, and I confirm that I have disclosed on the Health Questionnaire all pertinent information. I will notify Canada Prescription Service of any changes to my physical or medical condition by providing an updated Health Questionnaire.

6. I agree not to sue or make any claim against Canada Prescription Service connected in any way with any medicine provided to or ordered by me from or through Canada Prescription Service, and I release Canada Prescription Service from any liability, claims and causes of action regarding any medicine ordered by me or provided to me by or on behalf of Canada Prescription Service including, without limiting the generality of the foregoing, any liability, claims and causes of action related to the appropriateness, suitability, strength, dosage, fitness for any purpose or effectiveness of such medicine, any negligence, any side effects or ill effects from such medicine, and any late delivery, non-delivery or mis-delivery of any medicine.

7. Any electronic mail (e-mail) communication is not confidential and is subject to possible interception, loss and alteration. Canada Prescription Service is not responsible for and will not be liable to me for any damages in connection with any interception, loss or alteration of any e-mail sent to or from Canada Prescription Service.

8. Medical Information and other personal information that I provide to Canada Prescription Service is subject to the privacy laws applicable in the place where my prescription is filled and any other applicable privacy laws.

9. If I was directed to Canada Prescription Service by an intermediary such as a pharmacy benefit provider, health management organization or other healthcare service provide, I authorize Canada Prescription Service to release to that intermediary any information that may be necessary to process claims made in connection with medications I order from Canada Prescription Service.

10. I acknowledge that the pharmacy and other persons or entities involved in filling my prescription are not located in the United States, the physicians, nurses, pharmacists and technicians involved in my order for medicines are located and/or licensed in the United States and/or other countries, and any consultation and advice received by me from them is deemed to be received at the place of business of the persons providing that consultation or advice.

11. Orders are not binding upon Canada Prescription Service unless and until accepted by Canada Prescription Service and are subject to the availability of the medicine ordered. Canada Prescription Service reserves the right to refuse to accept any order. Prices shall be as posted on the Canada Prescription Service web site as at the time of acceptance of my order. Posted prices are subject to change without prior notice. Payment shall be made at the time of acceptance of each order, and shall be made by a credit card acceptable to Canada Prescription Service. I authorize Canada Prescription Service to bill my credit card for all products purchased by me, plus any applicable taxes and handling and shipping charges as indicated on each Order Form or on the Canada Prescription Service web site. All prices and charges are in U.S. dollars unless otherwise stated.

12. Canada Prescription Service shall be entitled to substitute a generic medicine in place of any prescription medicine where a generic medicine is available and appropriate under applicable laws and regulations unless my doctor has expressly indicated on my prescription that there must be no such substitution. I understand that child-protective packaging may or may not be used for any medications.

13. Title to and ownership of any medicine purchased from or through Canada Prescription Service shall pass to me at the place and time the medicine is packaged for shipment. I shall be responsible for any loss or damage that occurs during shipping and for compliance with any federal, state, local or other law governing the importation or shipment of the medicine to the place identified by me on the Customer Order Form.

14. Shipping and arrival dates are estimates only, and Canada Prescription Service is not liable for any loss or damage caused by failure to ship by the estimated ship date or by delays in shipment or arrival of medicines or failure of any shipment to arrive for any reason. In the event that Canada Prescription Service does not ship any medicine ordered by me or any shipment is not received by me due to the negligence or other fault of Canada Prescription Service, Canada Prescription Service will refund the price paid for that medicine and any taxes and handling and shipping charges, and Canada Prescription Service will have no further obligation or liability to me. If any medicine ordered is not received by me for any reason other than the negligence or other fault of Canada Prescription Service, Canada Prescription Service will not be responsible to me and I may claim against the persons at fault. I understand that I should make arrangements to ensure that I have a sufficient supply of medicines that I may need in case any shipment of medicine ordered from Canada Prescription Service is delayed or is not received by me for any reason.

15.  Once your prescription is received after you have placed an order on our website, your order will be processed within 48 hours. The expected shipping time for your order is fifteen (15) business days or approximately two and a half weeks. We do not guarantee shipping times, only the delivery.  All orders are final and non-refundable once shipped as Canada Prescription Service cannot legally accept returned pharmaceutical medications that are cancelled or refused after leaving the pharmacy. If a shipped order fails to arrive after 21 days we will reship it at no cost. Tracking is an additional expense that varies by country and may or may not be provided. USPS does not provide tracking for registered mail on their website.

16. I understand that after medicine is shipped it cannot be returned and all sales are final, except only that if medicine provided to me by or through Canada Prescription Service does not either correspond with the prescription provided by me or constitute a permissible generic medication under paragraph 12, I may contact Canada Prescription Service and, provided that my refund claim is approved, I may return the medicine for replacement or a refund of the price and any taxes and handling and shipping charges.

17. These terms and conditions, the Customer Order Form, the Health Questionnaire and the prices and terms on the Canada Prescription Service web site constitute the entire agreement between Canada Prescription Service and me. The agreement is severable, and if any provision is determined by a court to be invalid or unenforceable, the remaining parts of the agreement shall remain valid and enforceable.

18. The agreement between Canada Prescription Service and me is deemed to have been made in the country, province or state in which the pharmacy that fills my prescription is located. The relationship, and the resolution of any disputes arising, between Canada Prescription Service and me shall be governed by the laws of that country, province or state. Canada Prescription Service is not responsible for compliance with any local, state, federal or other laws that may apply where I reside. The courts of that country, province or state shall have exclusive jurisdiction to hear, determine and adjudicate upon any complaints, demands, claims or causes of action of any kind between Canada Prescription Service and me.

19. I am of the age of majority or older where I reside, am able to make my own medical decisions, and have had the opportunity to obtain professional medical and other advice about the matters set out or referred to above. If I am placing an order for medicine on behalf of someone else, I represent and warrant to Canada Prescription Service that I have all legally necessary consent, permission and authority to do so, and that the person on whose behalf I am placing the order or his or her administrators, committees and other legal representatives have had the opportunity to obtain professional medical and other advice about the matters set out or referred to above and understand and agree to those them.

20. I understand that when I place my order, I will automatically be placed on the Canada Prescription Service newsletter list to receive occasional announcements and offers via email. I understand that I will be able to opt out of this list from any email I receive.
